After removing your identification information from the non-personal data we collect, we may aggregate and use it to help us provide more useful information to our customers and to understand which parts of our Website, products, and services are of most interest. 6. How do we Collect and Use your Personal and Non-Personal Information?

8. Retention of Personal Information

For other personal information, you can request that we correct the data if it is inaccurate or delete the data if Global Diaspora News is not required to retain it by law or for legitimate business purposes. You can delete your account anytime or you may request deletion of your information at any time by contacting us to delete it for you. We will respond to your request within 30 days. Please note, however that information you have shared with others, or that other Users have copied, may also remain visible even if you request its deletion. Global Diaspora News may, at its sole discretion, remove or prevent access to, in whole or in part, any material submitted by you, for any reason or no reason, including any material it deems in violation of its standards.

 

10. Closing and Memorializing Account

You can close your account anytime. To do so, please send us an email at contact@GlobalDiasporaNews.com. If that happens, we will remove your name and other personally identifiable information from our publicly viewable database. If you close your account, we have no obligation to retain your information, and we may delete any or all of your account information without liability. However, we may retain certain data contributed by you if Global Diaspora News believes it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. Global Diaspora News may also retain and use your information if necessary, to provide the Service to other Users. Information you have shared with others, or that other Users have copied, may also remain visible. Global Diaspora News disclaims any liability in relation to the deletion or retention (subject to the terms herein) of information or any obligation not to delete the information. Global Diaspora News does not control when search engines update their cache, which may contain certain public profile information that has since been removed from Global Diaspora News’ publicly viewable database.

 

If we learn that a User is deceased, we may memorialize the User’s account. In these cases, we may restrict profile access, remove messaging functionality, and close the account if we receive a formal request from the User’s next of kin or other proper legal request to do so.

11. Children

We do not knowingly collect personal information from children under 13. We encourage parents to monitor and to be involved in the online activities of their children to ensure that no child under 13 registers on Global Diaspora News and also that no information is collected from a child without parental permission. If you are under 13, please do not register yourself or post on our Website any personal information. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, as soon as we verify the information, we will delete that information as soon as possible. If you believe that we might have any information from or about a child under 13, please contact us.

13. Your Interactions and Obligations towards other Users

 

  • You agree not to abuse the Global Diaspora News Website, products, and Service by using it to spam, harass, or otherwise violate our policies (e.g. Privacy Policy and User Agreement).

 

  • If you become a User (someone who has registered and has an account with us), you represent and warrant that you have never been convicted of a felony and that you are not required to register as a sex offender with any government entity.

 

  • You agree not to make any illegal and/or unauthorized uses of the Website, including collecting usernames and/or email addresses of Users by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Website.   • You shall not collect, use, copy, or transfer any information, including, but not limited to, personally identifiable information obtained from Global Diaspora News except as expressly permitted in the Privacy Policy or the Terms of Use Agreement or as the owner of such information may expressly permit.

 

  • You shall not use bots or other automated methods to access Global Diaspora News, add or download contacts, send or redirect messages, or perform other activities through Global Diaspora News, unless explicitly permitted by Global Diaspora News.

  • You shall not interfere with or disrupt or game Global Diaspora News or the Service, including, but not limited to, any servers or networks connected to Global Diaspora News, Global Diaspora News’ search algorithms.

 

  • Global Diaspora News reserves the right to investigate and terminate your membership if you have misused the Service or behaved in a way which could be regarded as inappropriate or whose conduct is unlawful or illegal.

 

  • You will not impersonate any person or entity. You will not “stalk” or otherwise harass any person. You will not express or imply that any statements you make are endorsed by Global Diaspora News without our specific prior written consent. You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of Global Diaspora News’ Service or contents.

When you become a User, you agree and consent to receive email messages from us. We send our e-newsletter free of charge to our visitors or customers that subscribe to it. Our goal is to keep our Users and visitors updated on the latest opportunities, news, programs and information related to our mission. You can opt out of our newsletters mailing list anytime by clicking on the “unsubscribe” link at the bottom of the previous newsletter you received. 17. Paid Membership and Subscription

 

17.1. Free Trials and Other Promotions

Registration on Global Diaspora News is free. We eager to helping all our Users to access and get the get the most of our services. Global Diaspora News may choose to make available free of charge any of our services and products. However, Global Diaspora News also reserves the right to change with or without notice, at its sole discretion, the pricing of any services, and end any free trial anytime as needed. Any free trial or other promotion that provides access to the Service must be used within the specified time of the trial. To help us cover our expenses and improve the Service, we created a few features that are paid.

 

17.2. Paid Membership

To help us with our expenses and to improve our services and products, some advanced features are paid (“Paid Member Subscription”). Some of the advanced features include but are not limited to:

After the end of the trial period, only Users that have the Paid Member subscription will have a full access to all our resources. If your financial conditions do not allow you to pay the membership fee, please contact us to see if you qualify for a waiver. We are eager to helping our Users enjoy our services. Our main goal is not just to make money but to help you.

 

You may terminate your membership and/or subscription at any time.  If you resign or cancel your membership and/or subscription, to help Global Diaspora News analyze and improve our services, you may be asked to provide a reason for your resignation/cancellation. If you terminate your paid subscription, your subscription may remain active until the end of your then-current subscription period (that is, the subscription period through which you had paid prior to your termination).

 

If your paid membership/subscription is terminated, we will notify you through the email address you provided during your application for membership, or such other email address as you may later provide to Global Diaspora News. All decisions regarding the termination of accounts shall be made in the sole discretion of Global Diaspora News. Global Diaspora News reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Global Diaspora News is not required to provide you notice prior to terminating your membership and/or subscription. Global Diaspora News is not required, and may be prohibited, from disclosing a reason for the termination of your account. You agree that Global Diaspora News shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

If you are on a free trial, you must cancel your subscription before the end of the trial period in order to avoid being charged a subscription fee. If you cancel prior to the end of the trial period and are inadvertently charged for a subscription, please contact us to have the charges reversed.

 

17.3. Billing and Payment

If you chose to use the paid Member service, Global Diaspora News bills you through your online billing account for use of our paid service. You agree to pay Global Diaspora News all charges at the prices you agreed to for any use of the service by you or other persons (including your agents) using your account, and you authorize Global Diaspora News to charge your chosen payment provider for the Service. You agree to make payments using that selected payment method. Global Diaspora News may correct any billing errors or mistakes that it makes even if it has already requested or received payment.

 

If you purchase any of our premium paid services and products, you agree that Global Diaspora News will store your payment card information. You also agree to pay the applicable fees as they become due plus all related taxes, and to reimburse us for all collection costs and interest for any overdue amounts. If you use the paid membership subscription, your obligation to pay fees continues through the end of the subscription period during which you cancelled your subscription.

 

17.4. Automatic Renewal for Paid Membership Subscription

If you subscribe to our premium membership services in order to use our advanced features, your subscription will continue indefinitely until cancelled by you. After your initial subscription commitment period, and after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. You agree that your account will be subject to this automatic renewal feature. If you cancel your subscription, you may use your subscription until the end of your then-current subscription term; your subscription will not be renewed after your then-current term expires. However, you won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period. By subscribing, you authorize Global Diaspora News to charge your Payment Method now and again at the beginning of any subsequent subscription period. You also authorize Global Diaspora News to charge you for any sales or similar taxes that may be imposed on your subscription payments. Upon the renewal of your subscription, if Global Diaspora News does not receive payment from your Payment Method provider, (i) you agree to pay all amounts due on your billing account upon demand, and/or (ii) you agree that Global Diaspora News may either terminate or suspend your paid subscription and continue to attempt to charge your payment method provider until payment is received. Upon receipt of payment, your account will be activated and for purposes of automatic renewal, your new subscription commitment period will begin as of the day payment was received.

By using Global Diaspora News Service, you also agree to our Refund Policy.

 

18. Copyright

You may not post, distribute, or reproduce in any way any copyrighted materials, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and posted on Global Diaspora News Website in a way that constitutes copyright infringement, please provide us with the following information:

Global Diaspora News reserves all rights not expressly granted in and to the Global Diaspora News content and the Global Diaspora News Service.

 

21. Arbitration and Governing Law

 

21.1. Arbitration Agreement

The exclusive means of resolving any dispute or claim arising out of or relating to the Private Policy or the Terms of Use Agreement (including any alleged breach thereof), the Service, or the Website shall be binding arbitration administered by the American Arbitration Association. The one exception to the exclusivity of arbitration is that you have the right to bring an individual claim against Global Diaspora News in a small-claims court of competent jurisdiction. But whether you choose arbitration or small-claims court, you may not under any circumstances commence or maintain against Global Diaspora News any class action, class arbitration, or other representative action or proceeding.

 

If you choose arbitration, it shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration. The arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties. Any judgment on the award rendered by the arbitrator shall be final and may be entered in any court of competent jurisdiction.

 

This Agreement or any claim, cause of action or dispute (“claim”) arising out of or related to this Agreement shall be governed by the laws of the state of Georgia regardless of your country of origin or where you access Global Diaspora News, and notwithstanding of any conflicts of law principles and the United Nations Convention for the International Sale of Goods.

 

You and Global Diaspora News agree that all claims arising out of or related to this Agreement must be resolved exclusively in Georgia, except as otherwise agreed by the parties. Notwithstanding the above, you agree that Global Diaspora News shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

 

21.2. Your Rights

If you comply with our Privacy Policies and Terms of Use Agreement, we grant you a limited, revocable, nonexclusive, nonassignable, nonsublicenseable license and right to access the Global Diaspora News Service, through a generally available web browser, mobile device or application (but not through scraping, spidering, crawling or other technology or software used to access data without the express written consent of Global Diaspora News or its Users), view information and use the Service that we provide on Global Diaspora News webpages and in accordance with this Agreement.

By using the Website or the Service in any manner, you agree to the arbitration provision in our Privacy Policy and Terms of Use Agreement. In doing so, you give up your right to go to court to assert or defend any claims between you and Global Diaspora News (except for matters that may be taken to small-claims court). You also give up your right to participate in a class action or other class proceeding. Your rights will be determined by a neutral arbitrator, not a judge or jury. You are entitled to a fair hearing before the arbitrator. The arbitrator can grant any relief that a court can, but you should note that arbitration proceedings are usually simpler and more streamlined than trials and other judicial proceedings. Decisions by the arbitrator are enforceable in court and may be overturned by a court only for very limited reasons.

 

21.3. Severability

This Privacy Policy and the Terms of Use Agreement contains the entire agreement between you and Global Diaspora News regarding the use of our Website and/or our Service. If any provision of this Agreement is found by a court of competent jurisdiction or arbitrator to be illegal, void, or unenforceable, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to effect the intention of the provision; and if a court or arbitrator finds the modified provision invalid, illegal, void or unenforceable, the validity, legality and enforceability of the remaining provisions of this Agreement will not be affected in any way.

 

21.4. Indemnity

You agree to defend, indemnify and hold Global Diaspora News, its subsidiaries, affiliates, shareholders, members, officers, directors, agents, and other partners and employees, harmless from and against any loss, liability, damages, obligations, costs or debt, claim, demand and expenses (including but not limited to attorney’s fees made by any third party) due to or arising out of:

 

  • your use of and access to the Global Diaspora News website and Global Diaspora News’ Services in violation of this Privacy Policy Agreement.
  • a breach of our Privacy Policy and Terms of Use Agreement and/or any breach of your representations and warranties set forth above.
  • your violation of any term of our Terms of Use Agreement or Privacy Policy;
  • your violation of any third-party right, including without limitation any copyright, property, or privacy right;
  • any claim that any of your actions (e.g. communications, User’s submissions or post) caused damage to a third party.

 

This defense and indemnification obligation will survive these Terms of Use Agreement and your use of the Global Diaspora News Website.

 

21.5. Assignment

The Privacy Policy and any rights and licenses granted thereunder, may not be transferred or assigned by you, but may be assigned by Global Diaspora News without restriction.
